Second Offense OWI
Any prior conviction counts, even if it was years ago, even if you were underage then, even if you pleaded guilty to a lesser offense of impaired driving. A prior refusal of a chemical test is also considered an OWI for purposes of a repeat offense.

Felony OWI (Third Offense)
Any combination of two past convictions for alcohol-related driving offenses pushes you into felony territory. You are facing either state prison or up to a year in county jail plus substantial community service. The court will levy thousands in fines, confiscate your license plates, revoke your license for a minimum of one year and possibly require an ignition interlock on your car when and if your license is reinstated.
Penalties are enhanced for severe intoxication, an injury accident or child endangerment. We make every effort to plead a felony OWI down to second offense (misdemeanor) or otherwise soften the consequences.
