Post-Divorce Changes to Custody or Financial Support

Enforcement Actions

The court can authorize wage garnishment, license suspension and other means to collect child support arrears. If a custodial parent is interfering with the other's parenting time out of spite, a judge can impose jail, award make-up time with the child or even alter custody.
Prenuptial Agreements
It is not a reflection on the marriage to prepare for the possibility of divorce. The Dorn Law Firm can draft or review a pre-marital agreement to clarify property division if the marriage does end. A "prenup" could address who gets certain assets (or debts), who keeps the house and whether there will be alimony. It cannot dictate child custody or child support.
Prenuptial agreements are common in second marriages, to maintain the assets each spouse brings to the marriage and to preserve inheritance rights for children from the first marriage. A prenup also makes sense if one party has substantial assets that would otherwise be exposed to equitable distribution in divorce.
